Chapter III

The Constitutional Articles

The operative text. Every article declares what it is for, what failure it anticipates, how it may be abused, and who may correct it.


Constitutional drafting conventionally states a rule and leaves its rationale to commentary. Dominicism rejects that convention. An article whose purpose is unrecorded will be interpreted, within two generations, by people who no longer know what it was for, and it will therefore be interpreted in whatever way is convenient. Each article below is stated in four parts, and all four parts are constitutional text of equal force.

Art. 1Original Contribution

Supremacy and Void Authority

Purpose
Establishes the Perennial Instrument as supreme law and declares that any act, order, appointment, or instruction contrary to it is void from the moment of its making.
Problem solved
Unconstitutional acts historically remain effective until struck down, which rewards speed. Voidness ab initio removes the advantage of acting first and litigating later.
Abuse prevention
Individuals may not declare acts void unilaterally; only a court may so declare. But a public servant who refuses an order later held void commits no offence, and one who obeys it may not plead superior instruction.
Accountability
The Court of the Instrument holds exclusive jurisdiction over declarations of voidness, on expedited timetable, with published reasons.
Art. 2

Equal Standing Before the Law

Purpose
Guarantees that every person within the jurisdiction is subject to and protected by the same law, in the same courts, with the same remedies and the same evidentiary standards.
Problem solved
Special forums, official immunities, and de facto prosecutorial deference have historically produced a two-tier justice system that corrodes legitimacy faster than any single act of corruption.
Abuse prevention
Immunity from prosecution is abolished for all offices; only narrow functional immunity for words spoken in legislative debate survives, and it does not extend to bribery, perjury, or incitement to violence.
Accountability
Annual publication by the Auditorium of prosecution and sentencing outcomes disaggregated by defendant office, wealth decile, and region, with statistical divergence triggering mandatory judicial inquiry.
Art. 3

The Residual Liberty Rule

Purpose
Declares that the citizen requires no authorisation to act and that state power exists only where the Instrument grants it. Silence in law is liberty for the citizen and incapacity for the state.
Problem solved
Administrative systems tend to accumulate implied powers. Over decades, 'not forbidden' becomes 'requires a licence', and the burden of justification inverts.
Abuse prevention
Any state body asserting a power must cite the textual grant. Courts may not infer powers from purpose, necessity, or past practice.
Accountability
A citizen may bring an action of Excess directly to a Tribunal of Assurance without showing personal injury, at no cost where the challenge is reasonably arguable.
Art. 4Original Contribution

Proportionality and Necessity of Restriction

Purpose
Requires that every restriction of a protected freedom be prescribed by published law, pursue a legitimate aim stated in the law itself, be necessary, be the least restrictive effective option, and carry an expiry date.
Problem solved
Rights are rarely abolished; they are qualified until nothing remains. Each qualification is individually defensible and the cumulative effect is unexamined.
Abuse prevention
The cumulative-burden test: courts assess a restriction not in isolation but against the total weight of existing restrictions on the same freedom.
Accountability
Every restriction lapses at its expiry unless renewed with fresh evidence of necessity; the state bears the burden at renewal.
Art. 5Original Contribution

The Doctrine of Lapse

Purpose
Provides that all statutes, agencies, subsidies, licences, surveillance authorisations, and delegated powers expire on a stated date unless affirmatively renewed on published evidence of effect.
Problem solved
Legislative inertia is the most reliable ally of bad law. Repeal requires attention, majority, and floor time; continuation requires nothing at all.
Abuse prevention
Omnibus renewal is prohibited: each expiring instrument is voted separately, and a renewal without an accompanying evaluation report is void under Article 1.
Accountability
The Auditorium maintains the public Lapse Calendar; the Council of Evidence certifies whether each renewal report meets the evidentiary standard.
Art. 6Original Contribution

The Horizon Statement

Purpose
Requires every bill, budget, treaty, and major procurement to carry a published assessment of its effects at ten, thirty, and one hundred years, including the cost of reversal.
Problem solved
Political time horizons are set by electoral cycles; consequences are not. The mismatch is the root of fiscal, environmental, and infrastructural decay.
Abuse prevention
Statements are drafted by the Standing Administration, not by the sponsoring minister, and are independently certified; a knowingly false statement is an offence of Abuse of Office.
Accountability
The Chamber of Horizons may reject a Statement as inadequate, which suspends the measure until a compliant Statement is produced.
Art. 7

Fiduciary Nature of Public Office

Purpose
Defines every public office as a trust held for the citizenry, importing the full fiduciary duties of loyalty, care, disclosure, and account.
Problem solved
Corruption is usually prosecuted as a discrete transactional crime, which requires proving a bargain. Fiduciary framing makes undisclosed conflict actionable without proof of a bargain.
Abuse prevention
Fiduciary liability is civil and disciplinary; criminal sanction still requires the ordinary standard of proof. The two tracks are kept formally distinct.
Accountability
The Probity Chamber hears fiduciary complaints in public, with appeal to the Tribunals of Assurance.
Art. 8Original Contribution

The Reverse Onus of Explanation

Purpose
Where a public officer's assets, undisclosed contacts, or unrecorded decisions cannot be reconciled with the public record, the officer must explain. Failure to explain terminates the appointment.
Problem solved
Sophisticated corruption is structured to be unprovable. Requiring the state to prove a bribe beyond reasonable doubt guarantees that competent corruption is never punished.
Abuse prevention
The onus is strictly limited: it applies to holders of public power, never to private citizens; it produces removal from office, never imprisonment; and it is triggered only by a documented, particularised discrepancy.
Accountability
Determinations are made by the Integrity Assize with full appeal on the record to the Court of the Instrument.
Art. 9

The Ledger of Interests

Purpose
Requires every officer, legislator, judge, senior administrator, and regulator to maintain a continuously public register of assets, income, gifts, obligations, and every substantive contact with parties affected by their decisions.
Problem solved
Periodic disclosure is retrospective and easily timed around. Continuous disclosure makes the pattern, not the event, visible.
Abuse prevention
Personal security exemptions are available on application to a judge, and the fact of an exemption is itself published.
Accountability
Automated cross-matching against the procurement, land, corporate, and lobbying registers, with discrepancies referred to the Integrity Assize.
Art. 10

Recorded Reasons

Purpose
Requires that every exercise of discretionary public power be accompanied by a written record of the decision, its author, its reasons, and the material considered.
Problem solved
Unreasoned discretion is unreviewable in practice even where it is reviewable in theory, because a court cannot detect an improper motive that was never written down.
Abuse prevention
A decision without a contemporaneous record is presumptively invalid on challenge; the presumption is rebuttable only by evidence of genuine emergency.
Accountability
Records are disclosable on request and are automatically published after a period fixed by class of decision.

Separation of the Five Orders

Purpose
Divides public power among the legislative, executive, judicial, administrative, and oversight orders, and prohibits any person from holding office in more than one simultaneously.
Problem solved
Three-branch models leave the permanent administration and the audit function inside the executive, where they can be defunded, reorganised, or staffed into silence.
Abuse prevention
Inter-order appointments require cross-order confirmation; no order may unilaterally set another's budget, which is fixed as a proportion of revenue by organic statute.
Accountability
The Revisory Convocation reports annually on the health of the separation, including budgetary and staffing pressure across boundaries.

Budgetary Insulation of Oversight

Purpose
Fixes the funding of courts, audit, ethics, and anti-corruption bodies as a constitutionally guaranteed proportion of general revenue, adjustable only by supermajority and never downward within a single term.
Problem solved
Defunding is the modern method of abolishing an inconvenient watchdog while leaving its nameplate on the door.
Abuse prevention
The proportion is bounded above as well as below, preventing oversight bodies from becoming a self-expanding estate.
Accountability
Actual disbursement is reported monthly; withholding of appropriated funds is an offence of Abuse of Office.
Art. 13

Freedom of Conscience, Belief, and Religion

Purpose
Guarantees absolute freedom of internal belief and broad freedom of its practice, together with equal freedom to hold no belief, and prohibits any established religion or religious test for office.
Problem solved
Confessional states persecute; militantly secular states persecute in the opposite direction. Both errors follow from the state taking a position on metaphysical truth.
Abuse prevention
Practice may be limited only under Article 4, and only where it coerces others, defrauds, or inflicts harm; doctrine itself is never justiciable.
Accountability
Any limitation on religious practice is reviewable directly by a Tribunal of Assurance on an expedited basis.
Art. 14Original Contribution

Freedom of Expression and the Integrity of Discourse

Purpose
Protects expression, including offensive, mistaken, and unpopular expression, while prohibiting incitement to violence, targeted intimidation, fraud, and the covert purchase of apparently independent speech.
Problem solved
Speech regulation aimed at content becomes a weapon of whoever governs. Regulation aimed at concealment and coercion does not.
Abuse prevention
No public body may determine truth or falsity as a condition of lawful speech. The state may compel disclosure of who paid for a message; it may not compel or forbid the message.
Accountability
All content-related orders are published in a permanent public register with reasons, and are appealable by any citizen.
Art. 15

Privacy and Freedom from Surveillance

Purpose
Protects the person, home, communications, movements, biometric identity, and data of every citizen against intrusion without individualised judicial warrant.
Problem solved
Bulk collection inverts the presumption of innocence at population scale and creates an instrument that no future government can be trusted to hold.
Abuse prevention
General warrants are void; every warrant names a person or defined premises, states a duration, and is subsequently notified to its subject once the investigation closes.
Accountability
The Cognition Authority publishes warrant volumes and error rates; a standing judicial commissioner audits a random sample of warrants each quarter.
Art. 16

Property, Contract, and Lawful Taking

Purpose
Protects ownership and freedom of contract, and permits compulsory acquisition only for a defined public purpose, under statute, with full compensation and a right of judicial challenge before transfer.
Problem solved
Insecure property destroys long-term investment; absolute property permits both blockade of public works and dynastic accumulation.
Abuse prevention
Acquisition for onward transfer to a private beneficiary is prohibited absent an overriding infrastructural purpose certified by the Fabric Authority and approved by the Assembly.
Accountability
A public register of every acquisition, its purpose, its price, and its eventual use ten years afterwards.
Art. 17

Due Process and Fair Trial

Purpose
Guarantees notice, an impartial tribunal, disclosure of evidence, counsel, the presumption of innocence, trial within a reasonable time, protection against double jeopardy and retroactive offences, and appeal.
Problem solved
Substantive rights are only as strong as the procedure available to vindicate them.
Abuse prevention
Procedural rights may not be waived as a condition of receiving any public benefit, licence, or employment.
Accountability
Judicial delay beyond published limits triggers automatic review and, where unremedied, discontinuance of the prosecution.
Art. 18

Effective Access to Justice

Purpose
Guarantees that the practical ability to bring a meritorious claim does not depend on wealth, through public defence, cost-shifting protection in constitutional cases, and a duty on courts to assist unrepresented parties.
Problem solved
A right that costs more to enforce than it is worth is a right in name only, and the resulting asymmetry favours precisely the actors most able to abuse power.
Abuse prevention
Frivolous-claim controls are applied by judges, not by fee barriers, and are reported publicly to detect misuse against inconvenient litigants.
Accountability
Annual publication of unmet legal need by region and case type, which the Assembly must formally answer.
Art. 19Original Contribution

The Concentration Brake

Purpose
Declares that accumulation of market, informational, infrastructural, or financial power sufficient to impair the state's regulatory capacity or the citizen's practical alternatives is a constitutional concern, and authorises graduated, evidence-based, judicially supervised remedies.
Problem solved
Antitrust law measures consumer price effects. Constitutional danger arises from dependency and leverage, which price does not capture.
Abuse prevention
Remedies escalate in defined stages — disclosure, interoperability, conduct conditions, and only at the final stage structural separation — each requiring a higher evidentiary showing before a court.
Accountability
Every Brake proceeding is public, adversarial, and appealable, and the triggering thresholds are published in advance so no firm is surprised.
Art. 20

The Debt Horizon Cap

Purpose
Limits total public liabilities, including unfunded future commitments, to a constitutionally fixed multiple of revenue, breachable only by declared supermajority for a named purpose with a binding repayment schedule.
Problem solved
Debt is the mechanism by which present majorities bind future ones without their consent.
Abuse prevention
The cap counts contingent and off-balance-sheet liabilities, which are the standard evasion; the Auditorium determines the classification, not the treasury.
Accountability
Breach automatically triggers a public hearing before the Chamber of Horizons and suspends new discretionary spending commitments until a schedule is adopted.
Art. 21Original Contribution

Emergency Powers and Their Termination

Purpose
Permits temporary extraordinary powers during a declared emergency, subject to a hard automatic expiry, judicial supervision throughout, and a prohibition on suspending elections, courts, or oversight bodies.
Problem solved
The permanent emergency is the oldest route from republic to autocracy and remains the most used.
Abuse prevention
Renewal requires an escalating threshold — simple majority, then two-thirds, then unanimous consent of the Council of Extremity plus judicial certification — so that indefinite emergency becomes procedurally impossible.
Accountability
A mandatory public inquiry into every emergency within one year of its termination, with findings binding on future declarations.
Art. 22

Civic Duties

Purpose
Establishes enforceable civic duties: obedience to lawful authority, honest taxation, service on juries and civic panels, truthful testimony, and respect for the equal standing of others.
Problem solved
Rights-only constitutions produce a citizenry that experiences the state as a vending machine and has no habit of shared responsibility.
Abuse prevention
Duties are specific and enumerated; no general duty of loyalty, patriotism, or ideological agreement exists or may be created.
Accountability
Duties are enforced through ordinary courts with ordinary procedural protections, never through administrative penalty.
Art. 23

Amendment and the Revisory Process

Purpose
Provides the sole lawful route to constitutional change, graduated by entrenchment tier, and requires a mandatory decennial review of the whole Instrument.
Problem solved
Constitutions that are too easy to amend offer no protection; constitutions too hard to amend are eventually overthrown rather than reformed.
Abuse prevention
No amendment may reduce the entrenchment of a provision below its current tier, preventing incremental unlocking of the core.
Accountability
The Revisory Convocation, half of whose members are selected by lot from the citizenry, publishes reasoned findings before any referendum.
Art. 24Original Contribution

The Duty of Refusal

Purpose
Imposes on every public servant, officer, and member of the armed and security services a personal duty to refuse a manifestly unconstitutional order, and protects the refuser absolutely from sanction.
Problem solved
Every constitutional collapse required thousands of ordinary people to carry out orders they knew to be unlawful. Deterrence must reach them, not only the person issuing the order.
Abuse prevention
The duty applies only to manifest unconstitutionality; a good-faith but mistaken refusal is protected from punishment though it may be corrected.
Accountability
A protected, independently administered channel for reporting refusals, and a criminal offence of retaliating against a refuser.
